These Terms & Conditions ("Terms") govern your access to and use of the websites and product properties operated by Atlas IP Holdings LLC, doing business as Atlas IP Conglomerate ("Atlas," "we," "us," or "our"), including (among others) BRidge, DownGust, Star Hop, LOCT, VayuDeck, NereusNet, OceanGrid, BrickTickler, Truck Tunnel, Calihan Dating, and CalihanHR (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old to create an account or use account-based or dating Services. You are responsible for the accuracy of information you provide and for maintaining the confidentiality of your credentials and all activity under your account.
The Services include informational websites, account and single-sign-on access, quote and intake tools, and product consoles. Some Services are offered on a subscription or per-unit basis; applicable pricing and plan terms are presented at the point of sale.
Quotes and estimates generated through the Services are for informational purposes, are not binding offers, and may be revised before a final order is confirmed. Paid plans are billed through our payment processor; unless stated otherwise, subscriptions renew automatically until cancelled, and fees are non-refundable except as required by law.
You agree not to: (a) use the Services unlawfully or in violation of these Terms; (b) attempt to gain unauthorized access to any system or data; (c) interfere with or disrupt the Services; (d) reverse engineer or scrape the Services except as permitted by law; or (e) misrepresent your identity or affiliation.
Certain environments are provided for demonstration or evaluation only. Data, trades, and interactions in such environments are simulated and non-production, are provided "as is," and may be modified or removed at any time.
The Services, including all software, content, trademarks, and other intellectual property, are owned by Atlas or its licensors and are protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. All rights not expressly granted are reserved. Product and brand names are trademarks of their respective owners.
The Services rely on and may link to third-party services (e.g., hosting, payments, email). We are not responsible for third-party services, and your use of them may be subject to their own terms.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless Atlas and its affiliates from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services or violation of these Terms.
We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of- laws rules. You agree that the state and federal courts located in Indiana will have exclusive jurisdiction over any dispute arising from these Terms or the Services, and you consent to personal jurisdiction there.
We may update these Terms from time to time. We will post the revised version here and update the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance.
